Body Corporate Report � Buyers Search, Management Rights

  • Attendance at the office of the nominated Body Corporate Manager. Perusal of Minutes of Meetings for last 2 years eg. AGM, Committee, Budget Committee,�Extraordinary General Meetings.
  • Photocopying Minutes for the last 2 years for inclusion in Report.
  • Perusal of General Correspondence.
  • Photocopying pertinent correspondence relating to Unit being purchased.
  • Searching for evidence of any Special Levies struck.
  • Perusal and photocopying of Community Management Statement, if required.
  • Searching for allocation under Exclusive Use By-Law for particular unit, if required.
  • Checking Registration of Plan.
  • Checking for existence of Fire Safety Certificate and Certificate of Classification.
  • Perusing Register of Engagements and Authorisations, if provided.
  • Noting details of current Agreements with Service Contractors, Letting Agents (Onsite Manager) and with Body Corporate Manager.
  • Photocopying Management Agreements if required.
  • Perusing records for evidence of any Court Action during the previous 2 years.
  • Perusing records for evidence of any Dispute Resolution.
  • Perusing and photocopying Asset Register, if provided.
  • Searching for details of improvements made to the Common Property which benefit the unit.

Disclosure Statements � Required by Sellers to attach to Contract for sale of a Unit

-Disclosure Statement

  • Attendance at the office of the nominated Body Corporate Manager.
  • Recording CTS/CMS number.
  • Recording BUP/GTP/SP number.
  • Recording Secretary of Body Corporate.
  • Recording Body Corporate Manager.
  • Completion of annual amounts of Administrative Fund and Sinking Fund Levies pertaining to lot.
  • Completion of details of any other levies struck.
  • Completion of Contribution Schedule of Lot Entitlements.
  • Completion of �Improvements on Common Property for which Buyer will be Responsible�.
  • Completion of Regulation Module details.
  • Completion of Body Corporate Committee details.
  • Completion of �Body Corporate Assets required to be Recorded on Register�

-Disclosure & Implied Warranty Statement

  • All of the above, plus-
  • Noting any defects in the common property or Body Corporate assets.
  • Perusing and photocopying budget, including details of proposed liabilities.
  • Perusing records to determine whether there are amounts available to Body Corporate for remedying any defects or discharging liabilities.
  • Searching for details of any unsatisfied judgments, orders or writs affecting the Body Corporate.
  • Searching records for details of any current Court Proceedings or applications to the Commissioner for Body Corporate & Community Management involving the Body Corporate or the property.
  • Searching for any Adjudicator�s orders�and proposals�for the Body Corporate to lodge a new Community Management Statement.
  • Searching records to determine whether there are any Special Contributions, other than as disclosed in the Disclosure Statement.
  • Searching records for evidence of any unregistered easements, leases or other rights capable of registration or required to be registered affecting the common property.
  • Searching records for any Body Corporate consents to improvements made to the common property which benefit the lot, or the registered owner of the lot.
  • Searching the records for any circumstances� which might materially prejudice the buyer in relation to the affairs of the Body Corporate.
